MP Sudi Acquitted in KCSE Certificate Forgery Case

Kapseret MP Oscar Sudi has been acquitted of all charges in a case in which he was accused of forging his academic documents.

In the case, the MP was also charged with making a false declaration to officials of the Independent Electoral and Boundaries Commission (IEBC) during the 2013 elections.

However, on Friday, June 7, a Magistrate Felix Kombo ruled that the prosecution had failed to prove its case, produced no formal documents to back up the allegations against Sudi.

In 2018, the High Court ordered that the controversial MP be prosecuted for submitting fake academic papers in the 2013 election.

The Court ruled that Sudi’s petition to block prosecution by the Director of Public Prosecution lacked merit. The legislator had filed a case seeking to stop his prosecution over fake academic papers.

In 2016, the Ethics and Anti-Corruption Commission (EACC) conducted an investigation into Mr Sudi’s academic record and revealed that he presented forged certificates to the electoral commission as he sought a nomination in the 2013 General Election.

EACC noted that Sudi’s Diploma Certificate in Business Management and Kenya Certificate of Secondary Education certificate were forged.

According to the report, the MP also made a false declaration under oath through a self-declaration form to IEBC.

“The MP uttered the said forged documents to IEBC and EACC with intentions to deceive the two commissions,” the report read in part.

In 2021, Kenya National Examinations Council (KNEC) provided evidence proving that Sudi forged his KCSE certificate.

Appearing in court, KNEC Principal Examinations Secretary, Nabiki Kashu, said the MP did not register or sit for the KCSE exams in 2006 at Highway Secondary School.

She added that Sudi’s certificate belongs to Parklands Secondary School.

Nabiki, who is the head of records and archives at KNEC, told the court that Sudi’s records do not appear in either Highway or Parklands Secondary Schools.

“In the letter, we were asked to find out whether such a candidate sat for KCSE in the year 2006 at Highway Secondary School in Nairobi and was awarded certificate serial number 3381074 under index 401006/081,” she said.

To corroborate her submission, Nabiki stated that the index number which purported to be Sudi’s belonged to someone else by the name Obaje Bob Onyango, who was registered and sat for the 2006 KCSE examinations at Parklands.

To further prove that Sudi might have forged the certificate, Nabiki noted that the code presented in his certificate belongs to Parklands secondary school.
