Three widows of the late Jonathan Moi are embroiled in a fight over who should be listed as the administrator of the deceased’s estate.
One of the widows Beatrice Mbuli Kipkemboi Moi, is accusing the first wife Sylvia Jonathan Moi of misrepresenting her and the entire family of the deceased.
She claimed that the first wife had alleged that they would jointly administer the estate of their deceased husband.
Jonathan Kipkemboi Moi died on April 20 this year after a long battle with pancreatic cancer.
Court papers seen by Citizen Digital on Tuesday revealed that Beatrice Mbuli Kipkemboi Moi averred that she was married to the deceased in accordance with the Akamba Customary Law on July 17, 1998.
She says they had two children of whom he used to take care of until his death.
Mbuli further claims that on June 27, 2018, they agreed that the three wives would jointly apply for letters of administration of the estate on behalf of their respective households.
According to her, the petitioners (the other two wives) did not obtain the consent of all the persons holding an equal or higher priority to the grant including his children and herself prior to institution of the proceedings.
She cited this as the reason that she failed to file her objection to the making of the grant within 30 days.
Mbuli is further accusing the petitioners of intentionally and willfully omitting her and her children from the list of beneficiaries of the estate of the deceased.
The court papers indicate that she interprets this as an attempt to disinherit them from their rightful share.
”That the petitioners have obtained the letter from the area chief indicating the deceased had only one wife and her children, a fact she knew to be false,” the court papers read.
She claims that she and her children stand to be prejudiced as they risk being denied their right to inheritance.
Mbuli wants the court to order an extension of time within which to file an objection.
Meanwhile; the third wife, identified as Faith Milkah Nyambura Mburu, has filed a court case against Mbuli and Sylvia claiming an exclusion from matters relating to the estate of the late Jonathan Moi.
“The respondents have sidelined the objector and her children from participating in the affairs which relate to the estate of the deceased,” court papers read.
On Tuesday, Justice Aggrey Muchelule directed that the matter be heard on November 26, 2019.
