The Water Resources Authority (WRA) wants to inform the public and all water users about a growing trend of non-compliance with the Water Act 2016 and the Water Resources Regulations 2025.
Under Section 12 of the Water Act 2016, WRA regulates the management, protection, conservation, and use of Kenya’s water resources. A key role of this responsibility is to ensure fair distribution of water among all legitimate users. This fairness is achieved through informed, evidence-based decisions, with the water use permitting system playing a vital role in promoting transparency, accountability, and sustainable water management.
Recently, WRA has observed a significant increase in violations, especially concerning illegal water abstraction and failure to obtain or follow water use permits. There are worrying instances where political figures have swayed or encouraged people to ignore compliance with the regulations. For example, in Kieni, Nyeri County, some abstractors were incited to break WRA directives, disrupting legal water management efforts. Claims that WRA vandalizes equipment are false.

Leaders of private entities found to violate regulations will face liability and prosecution. In government institutions, Managing Directors or equivalent leaders will be held accountable for violations of the Water Resources Regulations.
WRA reminds all water users that non-compliance with the Water Act and its Regulations is an offence. Such violations jeopardize the sustainability of water resources and disrupt fair and effective water allocation. Enforcement actions will be taken as prescribed by law.
Guidance for Water Users:
– Permit holders should ensure they comply with the law regarding their abstraction.
– Users without valid permits should visit WRA offices or apply through the e-permitting system.
Those with expired permits should apply for renewal.
From 10th December 2025, WRA will suspend all major disconnections related to water use fees so that Kenyans can celebrate the festive season. Enforcement of the Water Act and its Regulations will resume on 15th January 2026.
