Contrary to claims from President Ruto’s administration that criticism is based on falsehoods and propaganda, the opposition argues that the government’s actions reveal a pattern of democratic backsliding and institutional capture.

1. IEBC Selection Panel Delays
Following a recent High Court ruling, opposition parties swiftly nominated Dr. Koki Muli to the Independent Electoral and Boundaries Commission (IEBC) Selection Panel to meet the court’s October 24 deadline. However, delays by the Parliamentary Service Commission and the Speaker in forwarding the nominee list to the President raise serious concerns. The opposition views this delay as a politically motivated tactic to obstruct the IEBC formation process, placing Kenya’s democratic future at risk. They demand immediate gazettement of the panel to prevent further interference.

2. State-Sponsored Surveillance and Abuses
An investigation by Nation Media Group uncovered instances of police collusion with telecommunications companies to illegally access citizens’ data. The report highlights a pattern of state surveillance, harassment, forced disappearances, and extrajudicial killings. These actions, the opposition argues, violate the constitutional right to privacy as enshrined in Article 31 of Kenya’s Bill of Rights and the Data Protection Act of 2019. Telecommunications providers involved are warned of potential criminal accountability.

3. Accountability for Security Agencies
The opposition calls for accountability from security agencies including the National Intelligence Service (NIS), Directorate of Criminal Investigations (DCI), and Anti-Terrorism Police Unit (ATPU) for alleged abuses. High-ranking officials, from the Inspector General of Police to the Minister for Interior, are implicated in perpetuating a repressive environment hostile to political dissent. The opposition urges that these individuals be held accountable for infringing on Kenyans’ rights.

4. Presidential Responsibility
The opposition holds President Ruto accountable, demanding his resignation for alleged attempts to revert Kenya to a police state. They argue that, under his leadership, the government is undermining democratic freedoms, committing human rights violations, and defying constitutional obligations.

5. Support for Journalistic Freedom
The opposition commends journalists who, despite threats and gag orders, continue to uncover abuses and uphold democratic liberties. They view these journalists’ resilience as a testament to the enduring demand for transparency and accountability.
